Applying for Paid Family Leave in New York State
New York State has enacted legislation mandating that employers provide partial wage replacement for employees experiencing specific family events. These events include bonding with a newborn, caring for a family member with a serious health condition, or supporting family members when a loved one is deployed on military service.
Paid Family Leave benefits vary. However, some employers utilize insurance providers such as Guardian Insurance, which can cover up to 100% of an employee's wages.
How to Apply
The application process for Paid Family Leave can differ based on your employer and their insurance provider. However, the initial step often involves your employer notifying you about the benefit and providing you with an application and instructions.

Walk through the overall process

Basic information
On Page 4, you’ll fill out all the basic information, and starting on page 5 is where the applicant will need some help.
In Part A, question 13, you can share whether you’re thinking of taking one continuous leave or staggering your leave between multiple periods. This is helpful if you and your partner have very different work schedules and requesting leave at specific times might make more sense than one continuous period. For example, if you’re requesting leave to care for a family member going through multiple surgeries, it might make sense to take a week off right after each operation instead of taking one continuous leave that might run out before your loved one needs help going back to the hospital for follow-ups.

For each company Marielle will also walk through how to fill out questions 15 - 21 based on the company’s employment practice.
Once this section is completed just return the form to Marielle to complete the section for your employer.
Complete the Guardian Insurance Section
Here Marielle explains how to input your estimated dates of leave in the correct portion of the form: the top is for intermittent leave and the bottom is for continuous. These are estimates and may change after the leave begins.

Marielle will also walk you through the types of supporting documents a paid family leave application requires, especially if you’re seeking newborn leave but you’re not the birth mother.

And once you’ve gathered your supporting documents and completed the bonding certification section of the application, Marielle will walk you through the submission process, how to reference this application to check the status, and where the wage-covering payment would come from. That’s it!
